The case of the shipment of potatoes from Tustin continued in the Circuit Court here today with several Pennsylvania railroad officials being heard on the action, which involves claims of thousands of dollars by the McClintick Co. Judge. Hal. H. Cutler conditionally transferred the case here from Hersey, one of the points in his district, for the convenience of the railroad officials, the plaintiffs from Tustin and the attorneys who are from this city. Henry Miltner represents the railroad and EJ Millington the plaintiff. The shipments were intermediate from Tustin and Dewings, some of them a few years ago. Unreasonable delay in delivery is claimed, resulting in loss. There are two lawsuits that combine three vehicles and 11 vehicles, with all 14 causes of action that under the statute of the court are consolidated in the two lawsuits. At the request of counsel, Judge Cutler is hearing the cases without a jury, as it was deemed that the issues are too difficult for the trial, even though the questions involved are factual. The evidence is largely technical, and the war is legitimate.

The disposal of old cars and garbage will be an immediate concern for members of the natural resources committee of the Cadillac Area Chamber of Commerce and the Wexford County Board of Commissioners at a special joint meeting at 4:30 tonight. The meeting between the two bodies was called after the decision reached in the natural resources committee in the meeting held on Monday. Swimmers itch and dirt are other areas considered in the meeting at noon on Monday. The committee and commissioners will discuss the waste disposal project from the point of view of enforcing old laws. The committee found that it is difficult to get an exemption for dirty vehicles unless the laws are fully enforced. The two bodies will discuss ways to count dirty cars, pick them up and dispose of them.
