It is now a well-known story because it concerns a real manufacturing defect from the origin of the Scr (Selective Catalytic Reduction) system, which led to the opening of a case by the Competition and Market Guarantee Authority (Agcm). During the investigation of the administrative procedure, the identification of defects by the Psa Italia Business Group, responsible for the sale of the Citroen and Peugeot brands in Italy, emerged. In general, therefore, without going into the details of the individual case, it is enough to remember that the seller is required to deliver to the buyer a corresponding product, ie suitable for any use desired by consumers, and that art bis, paragraph 4, c. cons., provides that “the consumer has the right to a proportional reduction of the price or termination of the sales contract in accordance with article 135-quater in the event that … a lack of consideration will be seen, despite the seller’s attempt to restore the balance of the property” .
