The Court of Appeal in ‘s-Hertogenbosch ruled that X may not use the corrected price list from Eurotaxglass, because it does not prove to what extent the value of the vehicle is derived from that price list in this particular case.

X submits a BPM declaration to Maserati Ghibli 3.0 D and damages and pays € 3086. The dispute is an additional BPM assessment of € 2530. The Zeeland-West-Brabant District Court reduced the assessment to € 2203. X will appeal. There is no longer any dispute that 15.1 hours of overtime work on body work and painting should be considered for an hourly rate of € 84 (excluding VAT).

Hof ‘s-Hertogenbosch puts the damage in good standing at € 8200 (plus VAT). X may not use the corrected price list from Eurotaxglass, because it does not guarantee to what extent in this particular case the value of the vehicle comes from that price list value. XRAY price list is considered the starting point for determining the value of a re-purchase before the demolition. X does not make it clear that higher than 82% deductions should be used for repair costs. The high percentage is defended in general terms only. X appeal has a good basis. The evaluation has been reduced to € 904.
