Jackson Walker Defends Dismissal on Securities Fraud Charges Against Mitchell Hennessey – Jackson Walker


On Wednesday, March 20, US District Judge Andrew S. Hanen dismissed all charges against Jackson Walker’s client Mitchell Hennessey and his co-defendants, ruling that the government failed to state guilt in the case alleging securities fraud.

The government’s entire case was based on the theory that Mr. Hennessey committed securities fraud because he posted on social media that he owned the stock and his reasons for buying the stock but also did not state when he intended to sell the stock. The court rejected the government’s argument that it was a crime and concluded that Mr. Hennessey “did not deprive investors of their money or property through any misrepresentation(.)”
