The judge refuses to return the R$ 1.5 million boat seized in Manso

Judge Jean Garcia de Freitas Bezerra, of the Seventh Criminal Court of Cuiabá, rejected the request for the return of the fleet given by the person, who had sold the car to the private trainer Mayara Bruno Soares, arrested during the outbreak of Operation Mandatory. In the petition, he claims that he discussed the speedboat with the woman, but the sale price was not finalized and the property ended up being seized.

It is about a A 30-foot speedboat with 300 weapons, worth around R$ 1.5 million. The ship, in 2009/2010, with two diesel engines Mercruiser Diesel D.8 L 200 HP each, was arrested in Lago do Manso in February 2022. The speedboat was delivered to the Brazilian Navy last June.

According to the investigation of the Civil Police, Mayara Bruno Soares would be married to Benedito Max Garcia, one of the leaders of Comando Vermelho in Mato Grosso. He is a partner in the companies MB Soares Eireli and MB Soares Confecções, which carried out R$ 10 million loan and debt transactions, although they do not have any employees, let alone their physical headquarters.

At the time of the operation, Toyota Hillux, three Toyota Corollas, Jeep Renegade, Fiat Mobi, VW Gol, Jeep Compass, four Ford KA cars, two Honda Civics, two trucks (L 1518 and 13.180), were Land vehicles A Rover Discovery, a SeaDoo Jet-Ski, a BMW GS 310 motorcycle, as well as a speedboat, are the target of the order.

Leonardo Augusto Belmonte Zaim, the author of the request for restitution, claimed that he signed a purchase and sale agreement with Mayara Bruno Soares on July 1, 2021, agreeing that the ownership of the ship will be transferred only after its release, although the ownership was transferred immediately. . He claimed at the time, none of the installment payments of the purchase and sale contract were linked to the three checks that ended up being returned for January, March and April 2022.

However, the Judge did not accept the request while explaining that the checks are only about three of the ten agreed phases and will correspond to the fifth, seventh and eighth phases. He also said, in the decision, that it is possible that the amount was paid in another way, and it is important to listen to Mayara regarding the ownership of the property.

The judge also noted that the speed boat was seized in February 2022, when the six installments should have already been paid, and explained that at that time he could have reprimanded and asked for a suspension, thus continuing to own the ship to avoid suspicion. . The Public Prosecutor’s Office also said that the amount agreed as an initial payment, signed for R$ 60,000, was settled.

“Therefore, it is concluded that the settlement of the demand requires the instructions of the civil procedure which are not relevant in the current analysis. Therefore, for all the above and taking into account the opinions of the ministers, which I also adopt as a deciding factor, I see the restrictions opposed by Leonardo Augusto Belmonte Zaim to be unfounded”, says the decision.

Operation Mandatory was launched on January 18 last year with the joint efforts of the Federal Police, Civil Police, Military Police, Prison System and Federal Highway Police within the scope of the Public Security Task Force (FTSP-MT). .

The action sought to cancel the criminal accounting program on behalf of Comando Vermelho in Cuiabá and Várzea Grande, leading to the arrest of Jonas Souza Gonçalves Júnior, “Batman”, considered one of the leaders of the criminal organization and other members, including. Mayara who is pregnant, and her colleague Benedito Max.
