Because the defendant committed the same offense during the probationary period, the public prosecutor’s office of Upper Valais took action: it removed the enforcement of the fine provisions in the penalty order from January 2023 and sentenced the driver to an unconditional fine of 120 levels per days of 315. francs each – ie 37 ‘800 francs. The procedural costs of 400 francs, which the defendant also has to pay, are relatively small.
